# Terms of Service (Starter)
Effective date: February 13, 2026

These Terms of Service ("Terms") govern use of the Mashups platform ("Service"). By accessing or using the Service, you agree to these Terms.

## 1. Eligibility and Accounts
1. You must be at least 13 years old (or older where required by local law).
2. You are responsible for your account credentials and all activity under your account.
3. You must provide accurate registration information.

## 2. User Content and Rights
1. You retain ownership of content you upload ("User Content").
2. You grant Mashups a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, perform, and distribute User Content solely to operate and improve the Service.
3. You represent and warrant that you own or have all rights necessary to upload and distribute User Content.
4. You must not upload content that infringes copyrights, trademarks, publicity rights, or other rights.

## 3. Rights Modes
Mashups may require rights declarations at upload/publish, including:
1. `Owned`: You own all rights needed.
2. `Pre-cleared`: You used platform-approved licensed materials.
3. `Licensed`: You have third-party permission and can provide proof.

Mashups may restrict publication or monetization if rights information is incomplete or unverified.

## 4. Prohibited Conduct
You may not:
1. Upload unlawful, infringing, or fraudulent content.
2. Attempt to bypass technical restrictions, moderation, or rights controls.
3. Use bots/scraping to abuse the Service.
4. Harass, threaten, or impersonate others.

## 5. DMCA and Copyright Complaints
Mashups responds to copyright complaints under applicable law. See `legal/COPYRIGHT_POLICY.md` for notice and counter-notice procedures.

## 6. Repeat Infringer Policy
Mashups enforces a repeat infringer policy. See `legal/REPEAT_INFRINGER_POLICY.md`.

## 7. Monetization, Fees, and Payouts
1. Mashups may offer subscriptions, digital goods, tips, and payouts.
2. Platform fees, payout thresholds, and hold periods may apply and may be updated with notice.
3. Mashups may withhold, reverse, or adjust earnings for chargebacks, fraud, policy violations, or legal claims.
4. Taxes are your responsibility unless law requires otherwise.

## 8. Termination and Suspension
Mashups may suspend or terminate accounts for violations of these Terms, legal risk, abuse, or repeated infringement.

## 9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind to the extent permitted by law.

## 10. Limitation of Liability
To the fullest extent permitted by law, Mashups is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

## 11. Changes to Terms
Mashups may update these Terms. Material changes will be posted with an updated effective date.
